Dealing with an Arrest is never easy. Aside from the emotional impact it can cause, there is the looming criminal case ahead. An Arrest may come somewhat unexpectedly, by finding yourself in a compromising situation, or it may somewhat expected, as is the case with a Bench Warrant for Gun Crime or Arrest Warrant in a Domestic Violence incident. Often the Arrest takes place after questioning by a police officer, like with a DWI violation. Keep in mind that if you have been arrested, you are not considered guilty of anything. Because of that, it is important you are careful what you say to the police and interrogators. It is crucial to have the guidance of a Nassau County Arrest Lawyer during this time. You have a right to not say anything if you are questioned (pursuant to the 5th Amendment), and you have the right to be represented by a lawyer. It is important for your Criminal Court matter that you take full advantage of these rights. These rights apply to you if the Arrest took place in state court for any type of misdemeanor (drug crime or Petite Larceny for instance), or felony (a Sex Crime, Child Pornography or/and Rape for example). This would also apply if you are involved in a Federal Court case, like a White Collar Crime (i.e. Bank Fraud, Mail Fraud or even Securities Fraud). If you are embroiled in a case with the Federal Government, it is highly advisable that you contact a Federal Criminal Lawyer to assist you in this complicated and difficult process. The Office of Stephen Bilkis & Associates, PLLC has qualified attorneys that are ready to lend you guidance and sound legal advice. We have offices in Nassau County, Suffolk County, and throughout New York City including Manhattan, Brooklyn, Queens, Staten Island and the Bronx.
A Desk Appearance Ticket (DAT) is also considered an Arrest. Often people do not fully understand this, because they were not taken into physical custody and think of it as a traffic ticket. The difference with a DAT is only that you were not held in jail after your Arrest. You will still be required to show up at your Arraignment hearing.
After the Arrest it is important that you put together a plan of action. If you or a friend or family member was arrested in Nassau County via the following precincts they will be taken to Nassau County Central Booking:
