As in the rest of New York State, criminal cases in Westchester County are divided into those that constitute a Felony and those that qualify as a Misdemeanor. While misdemeanors--the more minor of the two offenses are still considered criminal cases. Violations including disorderly conduct and certain types of harassment cases along with Misdemeanors are heard in the smaller town and village courts, felonies in Westchester County are handled in White Plains at the central County Court.
Local city, town, or village courts will conduct your arraignment (for example Yonkers has its own criminal Court) on initial felony charges, then preside over initial appearances in court and handle felony hearings before your case is potentially sent for indictment to a Westchester County Grand Jury. If your case is indicted by the Grand Jury, it will be transferred to Westchester County Court in White Plains. Then the County Court will handle all aspects of prosecuting the indictment, from your arraignment through motions, hearings, and plea conferences, until your case is dismissed, completed with a trial verdict, or a plea is negotiated.
