If you are dealing with a pending Arrest, or a loved one has been arrested, you probably know how unsettling the experience can be. It's possible you were caught up in an unfortunate situation, or stopped and questioned by authorities before your Arrest, like with a DWI offense. Perhaps there was an Arrest pursuant to an outstanding Bench Warrant, a violent crime or perhaps a Traffic Ticket. However, the Arrest came about, you should bear in mind that you are considered innocent until proven guilty. If you believe that you may be in this situation, it is recommended that you contact a Queens Arrest Lawyer at your earliest convenience. You should be mindful that whatever you might say to the police or investigators can have an impact on your criminal case. Your Queens Criminal Lawyer will guide you in exercising your 5th Amendment rights and advise you that obtaining legal counsel is a wise approach for someone that has undergone an Arrest, or is being questioned or investigated by the police. This applies regardless of whether your Arrest took place in Kew Gardens for a misdemeanor matter, i.e. Petite Larceny or Assault, or for a felony such as a Sex Crime, including matters of Child Pornography and Sexual abuse. Depending on your situation, Federal authorities can also conduct an Arrest, which could then be pursued in Federal Court. A Federal Court case could include matters such as a White Collar Crime, which include Mail Fraud, Bank Fraud and/or Securities Fraud. If you are facing the pressure of the Federal Government pursuing an action against you, it is advisable to have the guidance of a Manhattan Federal Criminal Lawyer to assist you in preserving your rights while navigating the complicated legal system. Stephen Bilkis & Associates, PLLC can offer you a free consultation and support at any of our conveniently located offices, from Manhattan to Queens to Nassau County and Suffolk County.
Please note that if you were issued a Desk Appearance Ticket you were the subject of an Arrest (also desk appearance tickets are never given in Domestic Violence situations). The only difference with your receiving a DAT is that you were not taken into physical custody. This still means that you are required to show up at your Arraignment.

After the Arrest, for the next 24 hour period you or your loved one will be held in custody, until your Arraignment. During this critical time, it is extremely important that you are well aware of your rights.
The Police Department has the authority to question anyone that is accused of a violation or crime. However, this policy has been expanded and now allows interrogators more authority and leeway in conducting their interrogations. These question and answer sessions will be conducted irrespective of your innocence. Whether you are guilty or innocent, it is extremely important to not answer any questions. This is an important time with regard to your case, and any information you provide may be unintentionally misunderstood and therefore actually harm your case. That is why during this time it is so important to have secured the services of a Queens Criminal Lawyer. When you are represented by counsel and it is agreed that you will not be answering questions, the District Attorney and/or police may not gather any information from you.
