Grand Larceny is generally defined in NY Penal Law section 155.00. There are four subcategories of the crime, in the first through the 4th degree. Which particular category will apply depends on the dollar amount of the item stolen.
NY Penal Law Section 155.30 - Grand Larceny in the 4th: This law applies if the item stolen is valued under $2999.99, but at least $1,000. It also includes the taking of a firearm, or taking a public record or item of religious worship. It is a class E felony offense.
NY Penal Law Section 155.35 – Grand Larceny is the 3d Degree: This law applies if the item stolen is worth $49,999.99 or less, but not under $3,000. It is a class D felony offense.
NY Penal Law Section 155.40 – Grand Larceny in the 2nd Degree: A person is guilty of this crime where the property taken is higher than $50,000., but not over $999,999. It is a class C felony offense.
NY Penal Law Section 155.42 – Grand Larceny in the 1st Degree: A person is guilty of this crime if the property is valued at $1,000,000. or more. This crime is class B felony offense.
The dollar amounts involved with the crime of Grand Larceny are cumulative, unlike other theft crimes. If a defendant takes $1,000. from another for 50 days for instance, the crime would be categorized as Grand Larceny in the 2 degree. On the other hand if the defendant committed Burglary by entering a dwelling at taking $1,000. for 50 days, the defendant can be charged with 50 counts of Burglary.
