NY Penal Law 160.15 sets out the elements of Robbery in the 3 degree, which is the taking of another party’s property by intimidation or threat of force and is a D felony crime.

NY Penal Law 160.10(1) outlines the elements of Robbery in the 2d degree, which involves taking the property from another party, by force, or if you were assisted by an accomplice during the Robbery, or the Robbery victim was hurt, or you used a deadly weapon, or if the theft involved a motor vehicle. This is a C felony crime.

NY Penal Law 160.05 says that Robbery in the 1st degree is the taking of the property from another party, a deadly weapon (such as a gun) is used, or the victim was injured. If the gun was not operational at the time of the crime, either unable to discharge or was not loaded, it can be an affirmative defense to your charge.
